The Bespoke Atelier by Freya Enright – Terms & Conditions
Effective Date: 31 March 2025
1. Scope of Agreement
These Terms & Conditions apply exclusively to all bespoke commissions created through The Bespoke Atelier by Freya Enright. By commissioning a bespoke piece and/or paying a deposit, the client enters into a binding agreement governed by the terms below. These terms override Freya Enright’s general Terms of Service for ready-to-wear or online purchases.
2. Consultations & Payments
- Each bespoke project includes up to three (3) design consultations.
- Additional consultations are available at AUD $100 per session, subject to availability and project complexity.
- Once a final design is approved, a 50% non-refundable deposit is required to begin sourcing and production.
- In some cases (e.g. high-value gemstones or custom materials), a larger upfront deposit may be required to secure components.
- The remaining 50% balance is payable before dispatch or collection.
- No materials will be sourced or work commenced until the initial deposit has cleared.
- All quotes remain valid for 14 calendar days. After this period, pricing may be reviewed in accordance with material or supplier fluctuations.
3. Cancellations, Refunds & Amendments
- All bespoke orders are final and non-refundable once production has commenced.
- Requests to cancel, pause, or indefinitely postpone a confirmed order will not be accepted.
- Design amendments post-completion (e.g. resizing, engraving, aesthetic changes) may be possible and will be quoted on a case-by-case basis.
4. Client Responsibilities & Assumption of Risk
- Freya Enright Jewellery accepts no responsibility for any damage, loss or theft of the piece once it has been collected or dispatched.
- The client must disclose any known metal or gemstone allergies prior to design finalisation.
- Improper use, exposure to chemicals, or third-party repairs void the warranty.
- For remote clients, ring sizing must be accurate. Resizing or remakes due to client-provided errors will incur additional costs.
5. Production Timeline
- Standard production time is approximately 3–5 weeks from design approval and receipt of deposit.
- Timeframes may vary depending on complexity, gemstone sourcing, and studio availability.
- Freya Enright is not liable for production delays caused by suppliers, illness, or force majeure events.
6. Ownership & Intellectual Property
- All concepts, CADs, designs, sketches, and artwork remain the intellectual property of Freya Enright Jewellery.
- Clients may not reproduce, replicate, or distribute any designs for personal or commercial use without written consent.
- If a commission is cancelled prior to production, all associated creative assets remain the property of Freya Enright.
7. Warranty & Aftercare
- All bespoke pieces include a 3-month limited warranty covering craftsmanship and manufacturing faults.
- This warranty excludes wear and tear, accidental damage, stone loss, and alterations made by other jewellers.
- One complimentary clean and professional inspection is included within 3 months of delivery or collection.
- Additional aftercare services may be available at the studio’s discretion.
8. Delivery, Insurance & Collection
- Shipping is available at the client’s request and expense.
- Freya Enright Jewellery is not liable for delays, damages or losses incurred by third-party couriers.
- Ownership and risk transfer to the client upon collection or dispatch.
- Finished pieces must be collected within 14 days of final payment unless otherwise arranged. Storage fees may apply for late collection.
- All pieces remain the property of Freya Enright Jewellery until paid for in full.
9. Event Purchases
- Pieces sold through The Bespoke Atelier at exclusive events, exhibitions, or private showcases are considered bespoke and are subject to these same Terms & Conditions. By purchasing a piece at such an event, the client acknowledges and agrees to the following:
- All sales are final. No refunds, exchanges, or cancellations are permitted.
- These pieces are often one-of-a-kind or limited and are treated as bespoke items.
- If a manufacturing fault is identified within 3 months of purchase, a complimentary repair or store credit may be offered at Freya Enright’s discretion.
- Cash refunds are not provided.
- By completing payment at an event, the client confirms acceptance of these Bespoke Atelier Terms & Conditions.
10. Governing Law & Dispute Resolution
This agreement is governed by the laws of New South Wales, Australia.
Any disputes will be resolved exclusively under the jurisdiction of Freya Enright Jewellery’s principal place of business.
11. Acceptance of Terms
By engaging Freya Enright for a bespoke commission and/or making a deposit or purchase, the client confirms they have read, understood, and agreed to these Terms & Conditions in full.
